Obit: DAISY MAN KILLED AS RESULT OF ROW - Warren Smith, 49, is Shot to Death - Marvin Elsea Held for Murder.....
A shooting in Daisy early last night resulted in the death of Warren Smith, 49 year old linoleum salesman and the arrest of Marvin Elsea, 25, on a charge of murder. Both are residents of Daisy.
Arrested by county officers and detectives in his home, Elsea asserted he shot in self-defense and accused Smith of having threatened his life twice during the day. The shooting occurred in front of Elsea's home and Smith, struck in the left shoulder by a .22 caliber bullet, which ranged downward to his heart, walked almost a block before falling in a dying condition behind a grocery owned by Constable Earl Rogers.
Chief Depty Roy Morphew said Smith named Elsea as his assailant before dying. Elsea said "the trouble" which led to the shooting began in a Daisy garage yesterday morning at 11 a.m. He related to officers that he approached Smith, slapped him across the back and asked "How are you"? "He got mad, pulled the safety on his shotgun and threatened to kill me" Elsea asserted. "I told him I had never done him any harm and didn't want any trouble with him."
Elsea charged Smith with cursing him as he leveled the shotgun at him.
Elsea, according to his statement, slipped through a side door with his rifle in his hand and shot Smith as the elderly man was "raising the shotgun to shoot me".
Staggering across a field to the Daisy grocery, Smith fell behind the store, where he was found by several persons. His shotgun was lying beside him, officers reported. Dr. Wm. G. Stephenson, county cornoner, was called to the scene to make a preliminary investigation, later performing an autopsy on the body. The body was then taken to the Turner Brothers Funeral Home.
Elsea was arrested by County Detectives C. H. Dempsey and John Fryar and Patrolmen Hughie Baker and Elmer Cox. Held without bond, he will be given a preliminary hearing before Squire J. W. Johnston, tuesday afternoon at 1. p. m.
